AMES, Iowa – February 4, 2026 – Tell us what you think about a proposed rewrite of our Section 106 Programmatic Agreement. The Iowa Department of Transportation works to comply with various legislation, one of which includes the National Historic Preservation Act (NHPA).  Passed in 1966, the NHPA is our country’s prominent historic preservation law, and lays out the process that agencies use to develop projects, which is known as Section 106.  To comply with this law the Iowa DOT and the Iowa Division of the Federal Highway Administration have taken a statewide approach through the use of a Programmatic Agreement.  Iowa DOT has used similar agreements dating back to 2002, and the current effort is a rewrite of the agreement we put into place in 2018.

The Programmatic Agreement allows the Iowa DOT to outline procedures and expectations with stakeholders like the Iowa State Historic Preservation Officer and Sovereign Tribes and Nations.  Additionally, it covers scenarios like construction discoveries, and helps agencies like the Iowa DOT to find efficiencies and streamline processes when projects have little or no potential to effect historic properties.
